The works of a public performer, although original, are not fixed in a tangible medium as required by law and, therefore, are not eligible for copyright protection. However, the Nigerian Copyright Act recognizes such works as performers' rights and grants the performer exclusive control over their performance. This includes the rights to perform, record, live broadcast, reproduce in any material form, and adapt the performance. A performance, in this context, includes dramatic and musical performances as well as live literary recitals or renditions.
