Oman offers increased intellectual property right protection for trademarks, copyrights, trade secrets, patents, and geographical indications. Oman is a member of the World Intellectual Property Organization (WIPO) and it registered as a signatory to the Paris, Madrid and Berne conventions on trademark and intellectual property protection. Trademark and Patent in Oman

The trademark laws in Oman are compliant with the Trade-Related Aspects of Intellectual Property Rights (TRIPs). Trademarks are valid for 10 years in Oman and patents are protected for 20 years. The set of procedures and documents to register a trademark or patent in Oman is as follows:

  1. The application for the trademark and patent registration is to be submitted to the Intellectual Property department at the Ministry of Commerce and Industry (MOCI)
    • The application must be in accordance with the terms and conditions specified in the executive regulations for the IP law
    • The application must include a description of the mark and the list of goods and services for which trademark and patent registration is required
  2. The application will be examined by the department to ensure if the patent or trademark can be registered
    • During the examination process, the authority will put the objection and the applicant will be given an opportunity to respond to the objections of the department
  3. Once the objections have been resolved, the department will accept the application and the same would be published in the official gazette and the local newspaper
    • The purpose of publishing in the official gazette and local newspaper is to invite any interested party to oppose the registration of the trademark
    • The applicant will be given an additional 90 days to oppose the objection

After hearing both the applicant and the person who raises an objection, the department will decide whether to accept or reject the application.

Documents Required for Registering a Trademark in Oman

  • A copy of the applicant’s commercial registration documents
  • Details of goods and services for which the trademark is being registered
  • The power of attorney to be issued to the concerned trademark attorney in Oman
  • A copy of the trademark proposed to be registered in Oman in its original colour

Documents Required for Registering a Patent in Oman

  • A power of attorney (notarized and legalized) up to the Consulate of Oman
  • Abstract of the invention in English and Arabic
  • A notarized copy of the certificate of incorporation of the applicant in the Arabic language
  • Technical specification of the invention in English and Arabic
  • A certified copy of a priority document
  • A copy of deed assignment from the inventor(s) in Arabic translation (legalized)
  • A copy of the Patent Cooperation Treaty (PCT) publication, with the Arabic translation, if the work has been published
